E-COMMERCE TERMS AND CONDITIONS:
ORDERS(S)
- Your order with us constitutes your offer to purchase the products listed in the order, for the prices detailed therein.
- By submitting an order, you irrevocably warrant that the personal data and information being submitted are true and accurate and that you are lawfully authorized (including aged 18 years or more) to effect the said offer and purchase the goods, if your offer is accepted by us.
- Submission of your order does not automatically constitute acceptance of your order on our part. Confirmation of your order will be subject to availability of stock, the personal data and information that you have submitted being true and accurate etc.
- Any acceptance of your order will be confirmed to you in writing as soon as possible.
- Whilst we do our best to honour orders placed by our customers, we reserve the right (without need for justification) to decline (whether the whole or in part) such orders or propose modifications thereto.
- Where a product is not available, we reserve the right to propose a similar or equivalent product.
- It is forbidden for you to assign, whether the whole or in part, any order (whether confirmed or not) that you have placed with us.
- You will be given the option to effect payment for the goods by any one or more of the following means: direct debit, credit card payment, MCB Juice, payment on delivery and/or hire purchase. We reserve the right to review the modes of payment at our sole discretion, without notice.
- If you are opting for payment by way of hire purchase, your order will be subject to approval of your application by the hire purchase company before being able to complete the order. Your application to the hire purchase company will be submitted online directly to the hire purchase company and will usually take about 24 working hours to be processed. If your application for hire purchase is approved, we will notify you accordingly and request you to complete your order on our website.
- If you are effecting payment by credit card, you will be redirected to the Bank’s payment platform, which is a third party website and separate from our website.
- You will be required to open an account with us on our website, in order to effect purchases through our e-shop. Should you wish to delete your said account, please contact info@linxia.mu In the event of any breach of the terms and conditions governing our website and/or e-shop, we reserve the right to cancel such account and/or refuse certain access of users to our website / e-shop, without being liable for any indemnity whatsoever.
DELIVERY
- We will do our best to deliver your ordered goods the next working day following confirmation of your order and receipt of payment whichever is the later (unless otherwise is agreed to by us). However, we shall not be liable for any late delivery. You shall be notified of any change in expected delivery times.
- Delivery shall be effected and confirmed when you sign the delivery note and take possession of the goods delivered. No cancellation and/or refunds will be allowed after delivery.
- Payment shall be processed and debited prior to delivery (unless otherwise is agreed to by us). In the event of unsuccessful payment, we shall be entitled to cancel your order and claim from you amounts due, together with legal costs, charges and any applicable taxes thereon.
- We cannot be liable for any failure or delay in delivery due to force majeure, which includes for these purposes, cyclone class 3 or above, torrential rain declared by the Government, Government restrictions, delays in importation and/or by the third-party carrier.
- We may choose to limit delivery of purchases made through our e-shop to inland delivery only or delivery at locations within a certain radius of our office(s). Please note that our deliveries are limited to Mauritius (excluding Rodrigues).
- Our standard delivery is free of charge. For specified products a delivery fee of Rs.250/- per order may exceptionally apply. We reserve the right to review our delivery charges, at our sole discretion, without notice.
REFUND AND/OR CANCELLATION POLICY
- If the goods are found and agreed by us, to be damaged, tampered with and/or not as ordered when they arrive for delivery we will replace the defective items or erroneous order, in which case, delivery shall be effected free of delivery charges. Our liability of any nature whatsoever (whether direct and/or indirect, consequential etc.) in respect of any goods sold shall, to the fullest extent permitted by law and all intents and purposes, be limited to the agreed purchase price of those concerned goods only. No cancellation and/or refunds will be allowed.
- Where you refuse delivery without the right to do so, or we (or our transporter) have been unable to reasonably effect delivery due to incorrect address or unattended premises, we reserve the right to cancel the sale and dispose of the said goods as we deem fit as of right without need for any formality and/or to claim from you (additional) delivery charges.
- Warranty terms including warranty period shall be specific for each product and detailed in the product’s warranty card.
DISCLAIMER
- All cash or cash promotional prices of products are VAT inclusive.
- Prices, photographs, descriptions, graphics and technical data are non-contractual and are liable to change without notice, subject to typographical error and receipt of these products from our suppliers as well as their stock availability. Accessories are not included in the prices. Linxia will neither be held responsible in case of error or omission in any of these photographs, descriptions, graphics, or product characteristics nor in case of modification of the product's features.
